Be it enacted by the Council as follows:
Section 1. Chapter 1 of title 17 of the administrative code of the city of New York is hereby amended by adding a new section 17-180 to read as follows:
�17-180 Annual health plan report card. a. When used in this section:
1. "Health maintenance organization" means a health maintenance organization as defined in article 44 of the state public health law; and
2. "Insurance company" means any person, firm, association, corporation or joint-stock company conducting an insurance business authorized by a license issued pursuant to article 11 of the state insurance law.
b. Within 120 days of the effective date of the local law that added this section, the commissioner shall promulgate regulations requiring that each insurance company or health maintenance organization doing business in, or offering health insurance coverage or services to persons within, the city of New York shall provide to the commissioner on or before the first day of March of each year such information covering its activities for the immediately preceding calendar year as the commissioner shall require. Such information shall include, but not be limited to, outcomes and process data, information concerning the effectiveness of care provided, enrollment and disenrollment data, grievance and appeals data, and such other data as the commissioner shall require.
c. On or before the first day of April of each year, the commissioner shall issue a health plan report card providing a comparative evaluation of the services provided by each insurance company or health maintenance organization required to submit information to the commissioner pursuant to this section. Such health plan report card shall be prepared in English and such other languages as the commissioner shall deem to be necessary and appropriate in order to ensure the widest possible dissemination of the information contained therein.
d. The commissioner shall submit the health plan report card to the commissioner of personnel, and the commissioner of personnel shall include such health plan report card in such materials as are annually disseminated by the department of personnel during the period established by the city for its employees to transfer between or otherwise enroll in a health insurance plan.
�2. This local law shall take effect immediately.
