Be it enacted by the Council as follows:
Section 1. Article 19 of subchapter one of chapter one of title 27 of the administrative code of the city of New York is amended by adding a new section 27-191.2 to read as follows:
§27-191.2 Cellular telephone service antennas and equipment. (a) Cellular telephone service antennas and equipment shall not be attached nor installed nor in any way mounted on any parapet of a building nor on any exterior wall of any building. Cellular telephone service antennas and equipment may be attached to or mounted on the roof of a building, so long as such antennas and equipment is at least six feet from any parapet of a building or at least six feet from any edge of a building.
(b) Any existing cellular telephone service antennae and equipment that is not in compliance with subdivision a of this subdivision shall be reattached, reinstalled or remounted to comply with the provisions of subdivision a of this section as soon as practicable but in no event later than July 1, 2007.
§2. Article 19 of subchapter one of chapter one of title 27 of the administrative code of the city of New York is amended by adding a new section 27-191.3 to read as follows:
§27-191.3 Cellular telephone service antennas and equipment statement of need. Any application for permits to attach, install or mount any cellular telephone service antennas and equipment shall include a statement indicating why such antennae or equipment is needed.
§3. This local law shall take effect immediately upon enactment and shall apply to all permits issued on and after such effective date.
