Be it enacted by the Council as follows: Section 1. Subchapter 3 of chapter 2 of title 24 of the administrative code of the city of New York is amended by adding a new section 24-218.2 to read as follows: � 24-218.2 High-frequency devices for repelling or deterring persons from entering upon real property. No person shall use or permit to be used a device capable of emitting high-frequency sound that is designed to be audible only to children and young adults and is used for purposes of deterring such children and young adults from entering or remaining upon any real property. The provisions of this section shall not apply to law enforcement personnel acting in their official capacity or in cases of emergency, as such circumstances may be defined by the commissioner by rule. � 2. This local law takes effect 120 days after it becomes law, except that the commissioner of environmental protection shall take such measures as are necessary for the implementation of this local law, including the promulgation of rules, before such date.
