Summary

This bill would increase fines for failures to comply with the law related to commercial waste disposal and posting. It would also increase fines for subsequent violations and would waive the fine associated with a first violation of the posting requirements if the business can satisfactorily show that they had provided for the removal of their waste by a business licensed by the New York City Trade Waste Commission.

Be it enacted by the Council as follows: Section 1. Paragraph i of subdivision d of section 16-116 of the administrative code of the city of New York is amended to read as follows: (i) Except as provided in paragraph (ii) of this subdivision, violation of any of the provisions of this section or any rules promulgated pursuant thereto shall be punishable by a civil penalty of [not less than fifty nor more than one hundred] two hundred dollars for the first violation in any twelve-month period, five hundred dollars for the second violation in any twelve-month period, and six hundred dollars for the third and any subsequent violations in any twelve-month period. Any notice of violation, appearance ticket or summons issued for a violation of this section shall be returnable before the environmental control board which shall impose the penalty herein provided. No civil penalty shall be imposed for a first violation of subdivision b of this section upon a satisfactory showing before the environmental control board that the respondent was in compliance with subdivision a of this section on the date that the notice of violation, appearance ticket or summons was issued, except that such a violation shall count for the purposes of determining second and subsequent violations of this section. � 2.
