Be it enacted by the Council as follows: Section 1. Title 6 of the administrative code of the city of New York is amended by adding a new section 6-138.1 to read as follows: � 6-138.1 Participation by disabled-owned business enterprises in city procurement. The commissioner of the department of small business services, in consultation with the city chief procurement officer, shall, for each industry classification, review and compare the availability rates of disabled-owned businesses and the utilization rates of such businesses, in agency contracts and any contracts between prime contractors for the city and their subcontractors. On the basis of such review and any other information, including but not limited to, information relevant to the extent to which discrimination has an impact on the ability of disabled-owned businesses to compete for city contracts and subcontracts, the commissioner shall, by March 1, 2019, determine the need for a citywide program to promote opportunities in city procurement for disabled business owners and submit to the council a report that shall include the determination and the basis for such determination. For purposes of this section, disabled shall mean a person with a disability, as such term is defined in subdivision 16 of section 8-102 of title 8 of this code. � 2.
