Be it enacted by the Council as follows: Section 1. Subdivision c of section 16-119 of the administrative code of the city of New York is amended by adding a new paragraph 5 to read as follows: (5) If the department, the department of small business services or the department of environmental protection has established that material transported in a dump truck or other vehicle has been dumped, deposited or otherwise disposed of in violation of subdivision a of this section, there shall be a rebuttable presumption that the person whose name, or other identifying information, appears on any such material has violated such subdivision if the department, the department of small business services or the department of environmental protection establishes that such person owns or has control of (i) such dump truck or other vehicle or (ii) any dump truck. � 2.
