By Council Members Salamanca and Moya WHEREAS, the City Planning Commission filed with the Council on July 9, 2018 its decision dated July 9, 2018 (the "Decision"), pursuant to Section 201 of the New York City Charter, regarding an application submitted by AA 304 GC TIC, LLC, for an amendment of the text of the Zoning Resolution of the City of New York, modifying Appendix F for the purpose of establishing a Mandatory Inclusionary Housing area, which in conjunction with the related action would facilitate the development of a new, mixed-use building consisting of community facility, commercial and residential uses at 40-31 82nd Street (Block 1493, Lot 15), in the Elmhurst neighborhood of Queens, Community District 4 (Application No. N 180099 ZRQ), Community District 4, Borough of Queens (the "Application"); WHEREAS, the Application is related to applications C 180098 ZMQ (L.U. No. 166), a zoning map amendment changing property from an R6/C1-3 district to a C4-5X district; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter; WHEREAS, by submission dated July 16, 2018 and submitted to the City Planning Commission and the City Council on July 16, 2018 the Applicant withdrew the application. RESOLVED: The Council approves the motion to file pursuant to withdrawal in accordance with Rules 6.40a, 7.90 and 11.80 of the Rules of the Council. Adopted.
