Be it enacted by the Council as follows: Section 1. Subdivisions a and b of section 17-350 of the administrative code of the city of New York, as added by local law number 2 for the year 1991, are amended to read as follows: � 17-350 Violations and penalties. a. Any person who violates any provision of this subchapter or any of the regulations promulgated hereunder shall be guilty of a misdemeanor punishable by a fine of not less than [five hundred] $750 nor more than [five thousand] $7,500 or by imprisonment for not more than one year, or both, except that any person who violates any provision of this subchapter or any rule or regulation promulgated hereunder who knew or should have known that the dog is a dangerous dog as defined in paragraph (4) of subdivision c of section 17-342 shall be punishable by an additional fine of not less than $500 nor more than $5,000. b. In addition to the penalties prescribed by subdivision a of this section, any person who violates any of the provisions of this subchapter or any rule or regulation promulgated hereunder shall be liable for a civil penalty of not less than [five hundred] $750 nor more than [five thousand] $7,500. � 2. This local law takes effect 90 days after it becomes law, except that the commissioner of health and mental hygiene may take such measures as are necessary for the implementation of this local law, including the promulgation of rules, before such date.
