Be it enacted by the Council as follows: Section 1. Chapter 1 of title 9 of the administrative code of the city of New York is amended by adding a new section 9-161 to read as follows: � 9-161 Prohibition on recording privileged communications. The department shall not record or copy any written, audio, or visual communications, including telephone calls, email messages, letters, video conference meetings, and in-person meetings, between an incarcerated individual and a privileged individual. For the purposes of this section, the term "privileged individual" means any person who, as a result of their relationship with an incarcerated individual, is entitled to confidential communication under Article 45 of the Civil Practice Law & Rules. � 2.
