By Council Members Salamanca and Moya WHEREAS, Mansion Restaurant Inc., filed an application pursuant to Section 201 of the New York City Charter, for an amendment of the text of the Zoning Resolution of the City of New York, modifying Article I Chapter 4 (Sidewalk Cafe Regulations) to allow the Mansion Restaurant to apply for a revocable consent and license to operate an unenclosed sidewalk caf� adjacent to the restaurant's East 86th Street frontage, at 1634 York Avenue in the Yorkville neighborhood of Manhattan, Community District 8 (Application No. N 200078 ZRM) (the "Application"); WHEREAS, the City Planning Commission filed with the Council on November 10, 2020, its decision dated November 4, 2020 (the "Decision"), on the Application; WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d of the City Charter; WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on November 18, 2020; WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and WHEREAS, the Council has considered the relevant environmental issues, including the negative declaration issued January 21st, 2020 (CEQR No. 20DCP027M) (the "Negative Declaration"). RESOLVED: The Council finds that the action described herein will have no significant impact on the environment as set forth in the Negative Declaration. Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, and based on the environmental determination and consideration described in the report, N 200078 ZRM, incorporated by reference herein, and the record before the Council, the Council approves the Decision of the City Planning Commission. ARTICLE I GENERAL PROVISIONS Chapter 4 Sidewalk Cafe Regulations * * * 14-41 Locations Where Certain Sidewalk Cafes Are Not Permitted No #enclosed# or #unenclosed sidewalk cafes# shall be permitted on any of the following #streets#, portions of #streets# and areas, except that #small sidewalk cafes# may be permitted pursuant to the provisions of Section 14-43 (Locations Where Only Small Sidewalk Cafes Are Permitted). * * * Manhattan: * * * 79th Street - from the East River to Fifth Avenue 86th Street - from the East River to Fifth Avenue, south side only 86th Street - from the East River to 125 feet east of York Avenue, north side only, and from York Avenue to Fifth Avenue, north side only 116th Street - from Malcolm X Boulevard to Frederick Douglass Boulevard * * * 14-42 Locations Where Enclosed Sidewalk Cafes Are Not Permitted No #enclosed sidewalk cafe# shall be permitted on any of the following #streets#.
