Summary

This bill would require the Department of Environmental Protection and the Police Department to give a copy of the noise inspection report created after a 311 noise complaint to anyone who requests the report and provides the 311 tracking number. The person requesting the noise inspection report would not have to submit a Freedom of Information Law request to receive the report.

Be it enacted by the Council as follows: Section 1. Subchapter 2 of chapter 2 of title 24 of the administrative code of the city of New York is amended by adding a new section 24-217.2 to read as follows: � 24-217.2 Noise inspection reports. a. Where the department generates a noise inspection report pursuant to a complaint submitted through 311, any person may request a copy of such report by providing the 311 tracking number on a form and in a manner to be specified by the department subject to subdivision d of this section. b. Where the police department generates a noise inspection report pursuant to a complaint submitted through 311, any person may request a copy of such report by providing the 311 tracking number to the police department on a form and in a manner to be specified by such department subject to subdivision d of this section. c. The department or police department shall provide a copy of a report requested under this section within 14 days of receiving such a request. d. The department or police department shall not deny or decline to act on a request under this section on the ground that it fails to take the form of a freedom of information law request made pursuant to section 87 of the public officers law. � 2.
