Summary

This bill would grant the Department of Transportation (DOT) the authority to install and maintain tree guards on city property. Tree guards are fence-like structures installed around the perimeter of a tree pit in order to provide a physical barrier between a tree and the surrounding environment so that the tree may be better protected from physical damage and other harm.

Be it enacted by the Council as follows: Section 1. Title 19 of the administrative code of the city of New York is amended by adding a new section 19-159.6 to read as follows: � 19-159.6 Tree guard. a. Definitions. For the purposes of this section, the following term has the following meaning: Tree guard. The term "tree guard" means a fence installed around the perimeter of a tree pit that provides a barrier between a tree and the surrounding environment for the purposes of protecting such tree from physical damage and other harm. b. The department shall have jurisdiction over the installation and maintenance of any tree guard in a tree pit that is in or adjacent to a public sidewalk on property under the jurisdiction of either the department or the department of parks and recreation. c. The department shall, in conjunction with the department of parks and recreation, develop a website that describes the process for tree guard design, installation and maintenance. � 2.
