Summary

This bill would make it a violation of city law to park, stand, stop, or operate a motor vehicle with an obscured or defaced license plate. For parking, standing, and stopping violations, the bill would preserve existing civil penalties under state law, and would establish that such violation constitutes a misdemeanor punishable by a fine of not more than $1,000, imprisonment for not more than 20 days, or both. For the violation relating to operation of a motor vehicle, the bill would impose a civil penalty of $500 for a first violation and $1,000 for each subsequent violation committed within 6 months of the first violation. It would also establish that each such violation constitutes a misdemeanor resulting in the same punishment outlined above.

Be it enacted by the Council as follows: Section 1. Subchapter 2 of chapter 1 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-175.9 to read as follows: � 19-175.9 Obscured or defaced license plates. a. Definitions. For purposes of this section, the term "obscured or defaced license plate" means any license plate that does not comply with the requirements and prohibitions set forth in paragraph (b) of subdivision 1 of section 402 of the vehicle and traffic law. b. Prohibitions. 1. It is unlawful for any person to park, stand, or stop a motor vehicle with an obscured or defaced license plate. 2. It is unlawful for any person to operate a motor vehicle with an obscured or defaced license plate. c. Penalties. 1. The violation of paragraph 1 of subdivision b of this section shall constitute a misdemeanor punishable by a fine of not more than $1,000, or by imprisonment not to exceed 20 days, or both. 2. Any person who violates paragraph 1 of subdivision b of this section is liable for any monetary penalties applicable pursuant to the vehicle and traffic law. 3. The violation of paragraph 2 of subdivision b of this section shall constitute a misdemeanor punishable by a fine of not more than $1,000, or by imprisonment not to exceed 20 days, or both. 4. Any person who violates paragraph 2 of subdivision b of this section is liable for a civil penalty of $500 for a first violation and $1,000 for each subsequent violation committed within 6 months of a first violation. � 2.
