Summary

This bill would require the Department of Sanitation (DSNY) to, within 24 hours of receiving a report of an abandoned vehicle, determine whether such vehicle can be classified as “derelict” under state law, meaning it is abandoned, does not have license plates, and has a wholesale value of $1250 or less. If such vehicle is derelict and the vehicle identification number is not ascertainable by DSNY, the Department would be required to remove such vehicle or cause it to be removed from the street within 72 hours of receiving the report.

Be it enacted by the Council as follows: Section 1. The heading of section 16-128 of the administrative code of the city of New York is amended to read as follows: � 16-128 Removal of [incumbrances] encumbrances from streets. � 2. Subdivision a of section 16-128 of the administrative code of the city of New York is amended to read as follows: a. 1. The commissioner shall remove[,] or cause to be removed any vehicle, box, barrel, bale of merchandise, or other movable property or article or thing whatsoever found upon any street, in accordance with regulations adopted by the [board of estimate] commissioner. 2. If a vehicle found upon any street is identified as abandoned by the department or reported as abandoned to the department via the 311 customer service center, any other agency, or any official notification received by the department, including any electronic mail sent to the department by a council member or community board, the commissioner shall: (a) Within 24 hours of the department making such identification or receiving such report, determine if such vehicle is an abandoned vehicle described by subdivision 2 of section 1224 of the vehicle and traffic law; and (b) Within 72 hours of the department making such identification or receiving such report, remove or cause to be removed such vehicle from such street, provided that such vehicle is an abandoned vehicle described by subdivision 2 of section 1224 of the vehicle and traffic law and the vehicle identification number of such vehicle is not ascertainable by such department. � 2. This local law takes effect on the same date as a local law amending the administrative code of the city of New York, relating to the removal of derelict vehicles, as proposed in introduction number 3 for the year 2024, takes effect.
