Summary

This bill would require the Commissioner of the New York City (“City” or “NYC”) Department of Health and Mental Hygiene (“DOHMH Commissioner”) to identify the 10 most common neurological conditions and the 10 most common mental health conditions affecting older adults and to transmit this information to the Commissioner of the NYC Department for the Aging (“DFTA Commissioner”). The DFTA Commissioner, in collaboration with City agencies that frequently interact with older adults, would then study and issue a one-time report on the provision of City agency services to older adults with these conditions. Such report would include actions that City agencies will take in response to the study to improve services for older adults living with the neurological conditions and mental health conditions identified by the DOHMH Commissioner.

Be it enacted by the Council as follows: Section 1. a. Definitions. For purposes of this local law, the following terms have the following meanings: Agency. The term "agency" means any office, department, division, bureau, commission, or agency of government participating in the cabinet for older New Yorkers established pursuant to section 2405 of the New York city charter. City. The term "city" means the city of New York. Older adult. The term "older adult" means an individual 60 years of age or older. Services. The term "services" means services for older adults living with the neurological conditions and mental health conditions determined pursuant to subdivision b of this section. Stakeholder. The term "stakeholder" means a community-based organization, policy organization, or other entity that primarily serves older adults, including older adults living with the neurological conditions and mental health conditions determined pursuant to subdivision b of this section. b. Determination of neurological and mental health conditions. The commissioner of health and mental hygiene shall determine the 10 most common neurological conditions and the 10 most common mental health conditions affecting older adults in the city. Such commissioner shall transmit this information to the commissioner for the aging within 90 days after the effective date of this local law. c. Study. The commissioner for the aging shall conduct a study on the provision of agency services. Through such study, and in collaboration with agencies as defined in this section, the commissioner for the aging shall consider, at a minimum: 1. Which agencies have frequent interactions with older adults living with the neurological conditions and mental health conditions determined pursuant to subdivision b of this section; 2. Whether such agencies make efforts to reach and serve such older adults, and if so, how such agencies reach and serve such older adults; 3. Which trainings such agencies have in place to facilitate and tailor the provision of their services to such older adults; 4. How such agencies can improve service provision and outreach to such older adults; and 5. To the extent practicable, whether such agencies have sufficient resources and staff capacity to serve such older adults. d. Stakeholder input. In issuing the recommendations required pursuant to paragraph 4 of subdivision c of this section, the commissioner for the aging shall solicit input from stakeholders operating in the city. The commissioner for the aging shall also consider best practices identified from other jurisdictions. e. Information requests. Upon request of the commissioner for the aging, agencies shall provide such commissioner with any information, reports, and assistance such commissioner may require to implement this subdivision. f. Report. No later than 18 months after the effective date of this local law, the commissioner for the aging shall submit to the mayor and speaker of the council, and post on the department for the aging's website and the website of the cabinet for older New Yorkers, a report on the findings of the study required under this section, with such findings disaggregated by agency. Such report shall include, at a minimum, actions that agencies will take in response to such findings, and any additional agency capacity needs identified pursuant to paragraph 5 of subdivision c of this section. � 2.
