Be it enacted by the Council as follows: Section 1. Paragraph (n) of subdivision 5 of section 8-107 of the administrative code of the city of New York, as amended by local law number 40 for the year 2016, is amended to read as follows: (n) Discrimination on the basis of occupation prohibited in housing accommodations. (1) Where a housing accommodation or an interest therein is sought or occupied exclusively for residential purposes, the provisions of this subdivision shall be construed to prohibit discrimination on account of a person's occupation in: [(1)] (A) The sale, rental, or leasing of such housing accommodation or interest therein; [(2)] (B) The terms, conditions and privileges of the sale, rental or leasing of such housing accommodation or interest therein; [(3)] (C) Furnishing facilities or services in connection therewith; and [(4)] (D) Representing whether or not such housing accommodation or interest therein is available for sale, rental, or leasing. (2) Nothing in subparagraph (1) shall prohibit giving occupancy preference to individuals who are involved in artistic activities, provided that such preference is implemented or authorized by an agency or the state of New York. � 2.
