Summary

This bill would allow drivers to receive refunds for unused parking time purchased through parking application eWallets, and to transfer unused time from play-by-plate parking meters to another blockface with the same parking rate. Refunds or transfers would only be permitted if the unused time is worth more than the minimum purchase amount for the parking space, and the vehicle is not otherwise parked in violation of parking rules. The bill would also repeal the current ban on transferring unused parking time between blockfaces. Parking time purchased at pay-by-display parking meters, or parking application transactions not made through eWallets, would not be eligible for refunds or transfers.

Be it enacted by the Council as follows: Section 1. Subdivision a of section 19-167 of the administrative code of the city of New York is amended by adding new definitions of "eWallet" and "parking application" in alphabetical order to read as follows: eWallet. The term "eWallet" means a preloaded account on a parking application, funded with a credit or debit card, from which metered parking time may be purchased using funds from the preloaded balance. Parking application. The term "parking application" means a digital application provided by an agency that allows users to purchase parking time from parking meters through cashless transactions. � 2. Subdivision e of section 19-167 of the administrative code of the city of New York is REPEALED and a new subdivision e of section 19-167 is added to read as follows: e. Transfer or refund of pay-by-plate parking time. 1. Where an operator of a vehicle vacates a parking space with unused parking time remaining and such time was purchased using a parking application eWallet, the department shall refund the unused time to the parking application eWallet, provided that the unused time exceeds the minimum purchase increment for the blockface where the original purchase was made and that the vehicle is not parked in violation of any law or rule. 2. Where an operator of a vehicle vacates a parking space with unused parking time remaining and such time was purchased at a pay-by-plate parking meter, the owner or operator may transfer the unused time to a different blockface, provided that both blockfaces charge the same parking rate and the unused time exceeds the minimum purchase increment for the blockface to which the vehicle is transferred, and that the vehicle is not parked in violation of any law or rule. 3. Where an owner or operator of a vehicle does not utilize a parking application eWallet or a pay-by-plate parking meter to pay for parking, purchased parking time may only be utilized on the blockface for which it was purchased and unused parking time may not be refunded. � 3.
