No. 572 By Council Members Gennaro, Nurse and Hanif ..Title A Local Law to amend the administrative code of the city of New York, in relation to requiring the department of environmental protection to notify owners of property when the city of New York requests a base rental payment from the New York city water board ..Body Be it enacted by the Council as follows: Section 1. Subchapter 1 of chapter 3 of Title 24 of the administrative code of the city of New York, is amended by adding a new section � 24-335.1 to read as follows: � 24-335.1 Base rental payment notification. a. For purposes of this section, the following terms have the following meanings: Base rental payment. The term "base rental payment" means a rental payment for the water system and sewerage system from the New York city water board pursuant to section 8.2, or any successor provision, of the agreement of lease by and between the city of New York and the New York city water board dated as of July 1, 1985, as amended as of November 1, 1985. Sewerage system. The term "sewerage system" shall have the same meaning as provided in section 1045-b of the public authorities law. Water and sewer rates. The term "water and sewer rates" means any fees, rates, rents or other charges for the use of, or services furnished, rendered or made available by, the water system or the sewerage system. Water rate hearing. The term "water rate hearing" means a public hearing regarding the establishment, promulgation, fixing, or revision of water and sewer rates as required by section 1045-j of the public authorities law. Water system. The term "water system" shall have the same meaning as provided in section 1045-b of the public authorities law. b. In the event the city requests a base rental payment, the commissioner of environmental protection shall send, by first-class mail, no later than 15 days before the first water rate hearing following the request, a written notice of the request to the owner of each property served by the water system or the sewerage system. Such notice shall include: 1. The amount of the requested base rental payment; 2. The estimated impact of making the requested base rental payment on the property's water and sewer rates over the next 3 fiscal years, which shall be calculated based on the assumption that had such base rental payment not been requested, the resulting savings would have been used to reduce, or offset increases to, water and sewer rates; 3. Information on how to comment at an upcoming water rate hearing, including the date, time, and place of the next such hearing at which the property's water and sewer rates will be discussed; and 4. Information on how to submit a written comment to the department of environmental protection about the city's decision to request a base rental payment. � 2. This local law takes effect immediately.
