Res. No. 619 By Council Members Dinowitz, Restler and Morano Resolution calling on the New York State Legislature and Governor to amend the New York City Public Works Investment Act to lower the monetary threshold to utilize design-build in construction projects. Whereas, Design-build construction delivery arrangements, in which a single vendor is contracted to both design and build a project, have been found to accelerate construction timelines while reducing costs; and Whereas, Use of design-build by New York City agencies is regulated by state law, specifically the New York City Public Works Investment Act; and Whereas, The New York City Public Works Investment Act only authorizes city agencies to utilize design-build for projects estimated to cost $10 million and up, or $1.2 million and up for the Department of Parks and Recreation, the New York City Housing Authority, and other limited categories; and Whereas, Certain Parks projects like the installation of prefabricated toilets may not meet the monetary threshold for design-build and thus must be delivered according to slower and more cumbersome procurement methods; and Whereas, Amendments to the New York City Public Works Investment Act could allow agencies to utilize design-build on a wider range of projects to speed construction projects and control costs; now, therefore, be it Resolved, That the Council of the City of New York calls on the New York State Legislature and Governor to amend the New York City Public Works Investment Act to lower the monetary threshold to utilize design-build in construction projects.
