No. 1064 By Council Members Wilson, Restler, Hankerson, Hanif and Morano A Local Law to amend the administrative code of the city of New York, in relation to timeframes for agency approvals and change orders on small capital projects   Be it enacted by the Council as follows: Section 1. Chapter 1 of title 5 of the administrative code of the city of New York is amended by adding a new section 5-110 to read as follows: § 5-110 Timeframes for agency approvals and change orders on small capital projects. a. Definitions. For purposes of this section, the following terms have the following meanings: Agency approval. The term “agency approval” means a determination that a contracting agency is required to complete before a contractor may proceed with some portion of work under a covered contract. Change order request. The term “change order request” means a request submitted by a contractor under a covered contract for a change in the work or price of such contract, or an extension of such contract. Covered contract. The term “covered contract” means a contract for construction or design services entered into by a contracting agency for a covered project. Covered project. The term “covered project” means a capital project, as such term is defined in section 210 of the charter, that has an estimated construction cost of no more than ten million dollars as determined in the scope of such project. Department. The term “department” means the department of design and construction. b. The department shall, in consultation with the mayor’s office of contract services and other relevant agencies, establish timeframes for contracting agencies to complete agency approvals and change order requests on covered projects. Such timeframes shall be designed to minimize delay to covered projects. The department shall publish such time frames on its website and distribute them to contracting agencies. The department shall review such time frames no less than once every two years and shall revise them as necessary. c. If a contracting agency does not complete an agency approval or determine a change order request within a timeframe established pursuant to subdivision b of this section, such agency shall, no later than ten days after the expiration of such timeframe, provide a written explanation, signed by the commissioner of the contracting agency, to the contractor stating the reason for the delay and the date by which such agency approval or change order request is expected to be completed. § 2.
