No. 1063 By Council Members Wilson and Brewer A Local Law to amend the administrative code of the city of New York, in relation to pedicabs with electric assist Be it enacted by the Council as follows: Section 1. Paragraph 1 of subdivision a of section 19-171.1 of the administrative code of the city of New York, as added by local law number 19 for the year 2007, is amended to read as follows: 1. "Motorized pedicab" shall mean a wheeled device that is designed and constructed to transport or carry passengers, that is [propelled in whole or in part by other than] either (i) propelled with no assistance from human power or (ii) propelled by human power with the assistance of an electric motor that does not comply with section 20-254.1, and that is operated to transport passengers for hire. § 2. Subdivision a of section 19-171.2 of the administrative code of the city of New York, as added by local law number 31 for the year 2011, is amended to read as follows: a. For the purposes of this section, the term "pedicab" shall mean a bicycle or bicycle with electric assist as defined in the vehicle and traffic law or other device that is designed and constructed to transport or carry passengers, that is [solely] propelled by human power, and that is operated to transport passengers for hire. § 3. The definition of “pedicab” in section 20-249 of the administrative code of the city of New York, as amended by local law number 80 for the year 2021, is amended to read as follows: Pedicab. The term “pedicab” means a bicycle or bicycle with electric assist as defined in the vehicle and traffic law or other device that is designed and constructed to transport or carry passengers, that is [solely] propelled by human power, and that is operated to transport passengers for hire. § 4. Subchapter 9 of chapter 2 of title 20 of the administrative code of the city of New York is amended by adding a new section 20-254.1 to read as follows: § 20-254.1 Authorized equipment. a. A pedicab may be equipped with an electric motor of less than 750 watts that provides assistance when the person operating such pedicab is pedaling and that ceases to provide assistance when such pedicab reaches a speed of 15 miles per hour or any other speed as determined by the department by rule. b. Notwithstanding the width limitation set forth in section 102-c of the vehicle and traffic law, as added by chapter 58 of the laws of 2020, a pedicab equipped with an electric motor pursuant to this section may have a maximum width of 55 inches. § 5.
