Be it enacted by the Council as follows: Section 1. Chapter five of title twenty of the administrative code of the city of New York is hereby amended by the addition of a new subchapter thirteen, to read as follows: SUBCHAPTER 13 INFORMATION REGARDING NUTRITION IN FAST FOOD ESTABLISHMENTS �20-760 Definitions. a. Whenever used in this subchapter, the term "fast food establishment" shall mean and include a restaurant, food counter or drive through eatery which: 1. is part of a chain of similar or identical restaurants with a single name and chainwide supervision; and 2. has standardized menu and portion sizes, which are determined by the chainwide supervision; and 3. has a fixed number of items, as determined by the chainwide supervision, the number of which does not exceed fifty at any one time; and 4. has standardized packaging designed and/or issued by the chainwide supervision, which encloses the food to facilitate standardized, sanitary service and enable the consumer to carry the food away from the restaurant; and 5. presents the food to the consumer in such packaging without regard to the consumer's intent to consume the food on or off the premises. b. The term "nutrition information" shall mean and include information pertaining to ingredients, nutrients, calories, non-nutritive fiber, filler and additives, as defined by the United States food and drug administration. �20-761 Nutrition information required. a. Each fast food restaurant shall make available nutrition information for each item currently on the menu. b. Nutrition information shall be made available by means of a sign or poster conspicuously visible from the counter or window at which food is purchased, and/or by means of a flier given to the consumer. If nutrition information is available only by means of a flier, the availability of the flier shall be conspicuously posted on the menu or sign on which foods are listed. �20-762 Violation. Violation of this subchapter shall be punishable by a fine of not more than $500. Each day during which a violation goes uncorrected shall constitute a separate violation. �2.
