A LOCAL LAW
To amend the administrative code of the city of New York in relation to prohibiting the operation of school buses with passengers standing.
Be it enacted by the Council as follows:
Section 1. Chapter 6 of title 19 of the administrative code of the city of New York is amended by adding thereto a new section 19-606 to read as follows:
?19-606 a. It shall be unlawful to operate a school bus upon any road, street, avenue, boulevard or highway in the city of New York when the number of passengers is greater than the number of seats available, unless the driver of that bus determines that the failure to transport any child who is entitled to transportation on that bus would require that one or more children remain at a location without appropriate adult supervision. Under such circumstances, it shall be permissible for a driver of a school bus to allow one or more children to board a school bus even if the number of passengers would thereafter be greater than the number of seats available.
b. Any person, firm or corporation who shall violate the provisions of this section shall be guilty of a traffic infraction punishable by a fine not to exceed one hundred dollars in accordance with section 1800 of the vehicle and traffic law.
?2. This local law shall take effect immediately.
