Be it enacted by the Council as follows:
Section 1. Chapter 4 of title 20 of the administrative code of the city of New York is amended by adding a new subchapter 12 to read as follows:
SUBCHAPTER 12
USE OF INTERNET CAFES BY MINORS
� 20-698. Definitions. For the purposes of this subchapter, an "internet caf�" shall mean any privately owned and managed facility in which computers are rented or otherwise made available to members of the public for the primary purpose of connecting with the internet or world wide web. The term "internet caf�" shall not include any public library or school computer facility.
� 20-699. Use of internet cafes by minors. a. It shall be unlawful for any internet caf� to permit a minor to enter such caf� during the hours of instruction of the public school district in which the caf� is located.
b. The provisions of subdivision a of this section shall not apply in relation to any minor who: 1) has graduated from high school; 2) has completed a GED or other equivalency program; 3) is otherwise out of school permissibly; or 4) is accompanied by a parent or guardian.
c. The provisions of subdivision a of this section shall not apply over the weekend or during any vacation or other non-instructional period of the public school district in which the caf� is located.
� 20-699.1 Penalty. Any internet caf� that shall violate any of the provisions of this subchapter shall be subject to a civil penalty of not less than one hundred fifty dollars nor more than three hundred dollars for each violation.
�2. This local law shall take effect 90 days after its enactment.
