Be it enacted by the Council as follows: Section 1. Chapter 2 of Title 20 of the administrative code of the city of New York is hereby amended to create a subchapter 33 to read as follows: SUBCHAPTER 33 INTERNET CAFES � 20-539 Definitions. For the purposes of this subchapter, an "internet caf�" shall be defined as any commercial establishment that provides access to computers to the public through which said public may connect with the internet or world wide web. The term "internet caf�" shall not include any public library or computer facility located within a public or private school. � 20-540 Licenses Required. It shall be unlawful for any person to: (i) act as an internet caf� without first having obtained a license therefor, or (ii) operate or for the owner to permit the operation of an internet caf� unless such owner has first obtained a license for such internet caf�. � 20-541 Fees. The biennial fee for an internet caf�'s license shall be one hundred dollars. � 20-542 Penalties. Any internet caf� which violates any provision of this subchapter or any of the regulations promulgated hereunder shall be liable for a civil penalty of not less than one hundred fifty dollars nor more than three hundred dollars for the first violation and for each succeeding violation a civil penalty of not less than two hundred fifty dollars nor more than five hundred dollars. �2.
