Be it enacted by the Council as follows:
Section 1. Chapter one of title 10 of the administrative code of the city of New York is amended by adding a new section 10-166 to read as follows:
§10-166. Prohibition on the sale or installation of nitrous oxide tanks in motor vehicles. a. Definitions. For the purposes of this section:
(1) “Install” shall mean to connect, implant or fasten.
(2) “Motor vehicle” shall mean any device that is propelled by an engine in or upon which a person or material may be transported on the ground and which is intended to be operated upon a public highway.
(3) “Nitrous oxide tank” shall mean any canister or encasement containing the compound Nitrous Oxide (N20).
(4) “Person” shall mean an individual, partnership, company, corporation, association, firm, organization or any principal, director, officer, partner, member or employee thereof.
b. It shall be unlawful for any person to install or cause any other person to install a nitrous oxide tank in a motor vehicle.
c. No owner, lessee, manager, supervisor, employee or other person who maintains control of any location shall permit the installation of a nitrous oxide tank in a motor vehicle at such location. A person is liable under this subdivision if he or she knew or should have known about such installation.
d. Any person who violates subdivisions b and c of this section shall be guilty of a class A misdemeanor.
e. Each installation of a Nitrous Oxide tank in a motor vehicle made or caused to be made in violation of subdivision b or c of this section shall be deemed a separate offense.
§2. This local law shall take effect sixty days after its enactment into law.
