Be it enacted by the Council as follows: Section one: Chapter 1 of title 18 of the administrative code of the city of New York is amended by adding new section 18-134, to read as follows: §18-134 Prohibition on selling glass packaging or containers on or within one hundred fifty feet of any beach under the jurisdiction of the city of New York. a. It shall be unlawful for any person to sell or offer for sale on or within one hundred fifty feet of any beach under the jurisdiction of the city of New York any item made in whole or in part or which is sold or offered for sale with packaging or within a container made in whole or in part of glass. For purposes of this section, “packaging or containers” shall include but not be limited to glass bottles, canisters and dishes. b. Any person found to have violated subdivision one of this section shall be liable for a civil penalty in the amount of one hundred dollars for a first violation, two hundred fifty dollars for a second violation within a two-year period and five hundred dollars for a third violation or subsequent violation within a two-year period. §2 This local law shall take effect immediately upon enactment.
