Be it enacted by the Council as follows: Section 1. Subdivision h of section 20-452 of the administrative code of the city of New York is amended to read as follows: h. “Vend”. To hawk, peddle, sell, lease, offer to sell or lease, at retail, goods or services other than food in a public place. A general vendor in the act of preparing a pushcart, stand or vehicle on a street or sidewalk for use in a general vending business or dismantling such pushcart, stand or vehicle on a street or sidewalk after being used in a general vending business shall be considered to be vending for purposes of this subchapter. §2. Subdivision h of section 17-306 of the administrative code of the city of New York is amended to read as follows: h. “Vend". To hawk, peddle, sell or offer to sell food at retail in a public space, delivered immediately upon consummation of purchase. A food vendor in the act of preparing a pushcart, green cart or vehicle on a street or sidewalk for use in a food vending business or dismantling such pushcart, green cart or vehicle on a street or sidewalk after being used in a food vending business shall be considered to be vending for purposes of this subchapter. §3. This local law shall take effect immediately. LS 6484 LCC 12/10/08
