Be it enacted by the Council as follows: Section 1. Subchapter 3 of chapter 1 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-176.3 to read as follows: §19-176.3 Electric assisted bicycles. a. For the purposes of this section, the term “electric assisted bicycle” shall mean a bicycle with two or three wheels which has a saddle and fully operable pedals for human propulsion and also has an electric motor with a power output of less than seven hundred and fifty watts, whose maximum speed on a paved level surface, when powered solely by such a motor while ridden by an operator who weighs one hundred and seventy pounds, is less than twenty miles per hour. b. Except as provided in subdivision c of this section, all penalties applicable to bicycles in this code or in the vehicle and traffic law shall be double for electric assisted bicycles. c. This section shall not apply where the penalty for the violation would be in conflict with New York state or federal law. §2. This local law shall take effect one hundred and twenty days after its enactment into law. LF LS 1975 6/6/11
