Summary

This bill would require all cranes to be equipped with a global positioning system (GPS), or other similar device, which is capable of transmitting the location of the crane to which it is attached to the Department of Buildings (DOB). Where there is no device, DOB must be notified of the date upon which the crane will arrive at the site before work begins, and the date of the departure of the crane from the site upon conclusion of the work.

Be it enacted by the Council as follows: Section 1. Section BC 3319 of the New York city building code, as amended by local law 141 for the year 2013, is amended by adding a new section 3319.11 to read as follows: 3319.11 Crane location device. No crane operation that requires a certificate of on-site inspection, and other such types of crane operations where identified in rules promulgated by the commissioner, shall commence unless the crane is equipped with a global positioning system, or other similar device, that is approved by the department and capable of transmitting the location of the crane to which it is attached to the department. Where no such system or device has been approved by the department, (i) no crane operation subject to the provisions of this section shall commence until after the department has been notified by the equipment user, in a form and manner approved by the commissioner, of the date upon which the crane will arrive at the site, and (ii) upon the conclusion of the work, the equipment user shall also notify the department, in a form and manner approved by the commissioner, of the date of the departure of the crane from the site. Exception: Crane operations that utilize tower or climber cranes and require submission of an erection, jumping, climbing and dismantling plan to the department by a licensed engineer. � 2. This local law takes effect on May 1, 2018, except that the commissioner of buildings may take such measures as are necessary for its implementation, including the promulgation of rules, before such effective date.
