Summary

The bill would amend Local Law 66 of 2020 to provide that restraining an individual in a manner that restricts the flow of air or blood by sitting, kneeling, or standing on the chest or back in a manner that compresses the diaphragm is a misdemeanor under such law if the restraint is performed recklessly and causes injury due to asphyxiation.

Be it enacted by the Council as follows: Section 1. Subdivision a of section 10-181 of the administrative code of the city of New York, as added by local law 66 of 2020, is amended to read as follows: a. Unlawful methods of restraint. In the course of effecting or attempting to effect an arrest, [No] no person shall restrain an individual in a manner that restricts the flow of air or blood by: (i) compressing the windpipe or the carotid arteries on each side of the neck, or (ii) recklessly sitting, kneeling, or standing on the chest or back in a manner that compresses the diaphragm and causes injury due to asphyxiation [, in the course of effecting or attempting to effect an arrest]. � 2.
