Summary

This bill would consolidate the Archival Review Board and the Archives, Reference, and Research Advisory Board into the Library and Archival Review Advisory Board. The Library and Archival Review Advisory Board would have nine members, five of whom are appointed by the Mayor, three of whom are appointed by the Speaker of the City Council, and the Commissioner of the Department of Records and Information Services serving as chairperson. Initial appointments would be for one-year, two-year, or three-year terms, with each subsequent appointment being for four-year terms to create a staggered structure and prevent the whole Board from being vacant at the same time. The members of the Library and Archival Review Advisory Board would complete the same functions previously assigned to the Archival Review Board and the Archives, Reference, and Research Advisory Board. These functions include issuing a report on the development of municipal archives, reference and research services in the city, and archival processing of city papers.

Be it enacted by the Council as follows: Section 1. Section 3005 of the New York city charter, as added by local law number 22 for the year 2003, is amended to read as follows: � 3005. [Archival] Library and archival review advisory board. a. There shall be in the department [an] a library and archival review advisory board which shall consist of [five] 9 members; [two] 3 of whom shall be appointed by the speaker, [two] 5 of whom shall be appointed by the mayor, and [one] 1 of whom shall be the commissioner, who shall serve ex officio as chairperson of the board. [At] The mayor's appointments shall include at least [one such appointment shall be a] 1 professional archivist, 1 professional librarian, and [one other such appointment shall be a] 1 professional historian. [The members of the commission, other than the chair, shall be appointed within 30 days of the effective date of this section and] Members of the library and archival review advisory board shall be entitled to reasonable expenses[. All appointed members of the commission] and shall be residents of the city. b. Members, other than the chair, shall serve for terms of [four] 4 years from [such] the date of appointment, provided that of those members first taking office, 1 appointed by the mayor and 1 appointed by the speaker shall be appointed for a 1 year term; 2 appointed by the mayor and 1 appointed by the speaker shall be appointed for a 2-year term; and 2 appointed by the mayor and 1 appointed by the speaker shall be appointed for a 3-year term. Members shall serve until their successors are appointed. Vacancies in appointed membership of the board shall be filled by appointment by whosoever was responsible for [such] the original appointment. c. The board shall meet once every [90] 120 days or upon the request of any of its members. d. Any member [of such board] shall have complete access, with the concurrence of the commissioner, during work hours, to inspect and review any appraisal, organization, processing or archiving of city records in the custody of an entity with which an agreement has been entered into for the purposes specified in subdivision [five] 5 of section 3003. [Such] The board may request and receive, from the department, assistance and data as may be necessary for the proper execution of its powers and duties. [Such] e. No later than December 31, 2026, and annually by December 31 thereafter, the board shall [render annually to the mayor] submit a report [reviewing] to the speaker of the council and the mayor on the development of municipal archives, reference and research services in the government and administration of the city, and the archival processing of any city papers during the year for which the report has been written. � 2. Section 3007 of the New York city charter, as amended by a vote of the electors at the general election held on November 8, 1988, is amended to read as follows: � 3007. Departmental [libraries] collections. The commissioner shall analyze the needs of each city agency, except the law department, with respect to the establishment and maintenance of any library or research facility therein, and make such recommendations as may be appropriate in the circumstances. � 3. Section 3009 of the New York city charter is REPEALED. � 4. All members of the library and archival review board shall be appointed within 30 days of the effective date of this local law. � 5.
