A Local Law to amend the administrative code of the city of New York, in relation to paying sidewalk and roadway cafe revocable consent compensation in quarterly installments

Be it enacted by the Council as follows:
Section 1. Section 19-160 of the administrative code of the city of New York is amended by adding a new subdivision l to read as follows:
l. The operator of a sidewalk or roadway cafe may pay for the annual compensation for a revocable consent for a sidewalk cafe pursuant to subdivision h of section 19-160.2, for a seasonal roadway cafe or a year-round roadway cafe pursuant to subdivision c of section 19-160.1, or for an enclosed sidewalk cafe pursuant to subdivision i of section 19-160.2, in quarterly installments. If the department determines, after an opportunity to be heard, that such an operator has failed to timely pay any 2 quarterly installments during the same term of a revocable consent, such operator shall no longer be eligible to pay in quarterly installments for the remainder of such term and shall be required to make any subsequent annual compensation payments as annual payments.
� 2. Subdivision c of section 19-160.5 of the administrative code of the city of New York, as added by local law number 121 for the year 2023, is amended to read as follows:
c. In addition to any other enforcement procedures authorized by this subchapter, the department may, after providing notice and an opportunity to be heard, suspend or revoke a license to operate a sidewalk or roadway cafe and order the removal or sealing of such sidewalk or roadway cafe for (i) 3 or more violations of the same provision of this subchapter or rules of the department promulgated under this subchapter within a 2 year period; [or] (ii) any 6 or more violations of any provision of this subchapter or rules of the department promulgated under this chapter within a 2 year period; or (iii) 3 or more failures within a 2-year period to timely pay the annual compensation for a revocable consent to operate a sidewalk or roadway cafe.
� 3. This local law takes effect 240 days after it becomes law.
