No. 1059 By Council Members Santosuosso, Restler and Hanif A Local Law to amend the administrative code of the city of New York, in relation to the installation of porous pavement as part of street reconstruction projects, and to repeal and replace section 19-155 of such code, relating to a study on permeable roadway and sidewalk materials Be it enacted by the Council as follows: Section 1. Section 19-155 of the administrative code of the city of New York is REPEALED and a new section 19-155 is added to read as follows: § 19-155 Porous pavement as part of street reconstruction projects. a. Definitions. For purposes of this section, the following terms have the following meanings: 10-year rainfall flood risk area. The term “10-year rainfall flood risk area” has the same meaning as set forth in subdivision a of section 24-809. Coastal flood risk area. The term “coastal flood risk area” has the same meaning as set forth in subdivision a of section 24-809. Flood hazard area. The term “flood hazard area” means an area within the 10-year rainfall flood risk area or the coastal flood risk area. Porous pavement. The term “porous pavement” means permeable pavement designed to reduce surface runoff by allowing water to infiltrate through the surface of such pavement, including, but not limited to, porous concrete, porous asphalt, and permeable pavers. b. The department, in collaboration with the department of design and construction, shall install porous pavement as part of each street reconstruction project located within a flood hazard area. Notwithstanding the foregoing, the department shall not be required to install porous pavement as part of such a project if the department determines in its professional engineering judgment that such installation would be: (i) inconsistent with the department’s guidelines regarding the installation of porous pavement; or (ii) infeasible or otherwise impracticable. § 2.
