Be it enacted by the Council as follows: Section 1. Chapter 1 of title 17 of the administrative code of the city of New York is hereby amended by adding thereto a new section 17-179 to read as follows: �17-179 Parental notification of communicable diseases or infestations. a. For the purposes of this section, the following terms shall be defined as follows: 1. "Camp" means a property consisting of a tract of land and any tents, vehicles, buildings, or other structures that may be pertinent to its use, any part of which may be occupied (i) on a scheduled basis at any time between June 1 and September 15 in any year by ten or more children under sixteen years of age, under general supervision, primarily for the purpose of outdoor or indoor organized group activities for a period of less than twenty-four hours on any day the property is so occupied and for which no provisions are made for overnight occupancy by such children; or (ii) by ten or more children under eighteen years of age, under general supervision, primarily for the purpose of outdoor or indoor organized activities and for which provisions are made for overnight occupancy of children; provided, however, that this definition shall also include "traveling summer day camp," "Municipal summer day camps," and "Municipal traveling summer day camp" as all such terms are defined and used in section 48.03 of the health code of the city of New York; and provided further, that this definition shall not apply to: (i) any place occupied by children under eighteen years of age for overnight occupancy of seventy-two consecutive hours or less; and (ii) activities such as unscheduled or drop-in neighborhood-center settings, single-purpose activity such as athletic events and associated training practice, "special olympics," little league baseball, Pop Warner football; and recreational activity without a specified time period of attendance required. 2. "Child care service" means any public, private or parochial child care center, day nursery, day care agency, nursery school, kindergarten, play school, or other similar school or service, whether or not care is given for compensation. 3. "Children's institution" means any public, private or parochial congregate institution, group residence, group home or other place where, for compensation or otherwise, seven or more children under twenty-one years of age are received for day and night care apart from their parents or guardians. 4. "School" means any public, private or parochial elementary, middle or high school, but does not include a day care service attached to such public, private or parochial school. b. (1) Whenever the owner or person in charge of a school, child care service, children's institution or camp has knowledge that a child attending the school, child care service, children's institution or camp has been diagnosed as being afflicted with any of the communicable diseases or infestations listed in this section, the owner or person in charge of such school, child care service, children's institution or camp shall, within two weekdays of receipt of notice of such diagnosis, provide or cause to be provided oral or written notification to the parents or guardians of all children attending such school, child care service, children's institution or camp and to all employees of such school, child care service, children's institution or camp, with respect to the possible existence of the disease or infestation in the school, child care service, children's institution or camp and its symptoms. (2) Notice shall be provided with respect to the following communicable diseases or infestations: Amebiasis Anthrax Babesiosis Botulism Brucellosis Campylobacteriosis Chickenpox Cholera Conjunctivitis Diptheria Encephalitis Enterobius vermicularis (pinworms) Giardiasis Hemophilus influenzae (invasive disease) Hepatitis (A; B; non-A; non-B) Histoplasmosis, new cases Kawasaki syndrome Legionellosis Leprosy Leptospirosis Lyme disease Malaria Measles Meningitis (1) Aseptic (2) Hemophilus (3) Meningococcal (4) Other Meningococcemia Mumps Pediculosis (lice) Pertussis (whooping cough) Plague Poliomyelitis Psittacosis Rabies Reyes syndrome Rocky Mountain spotted fever Rubella Congenital rubella syndrome Salmonellosis Shigellosis Staphylococcal disease Streptococcosis, including scarlet fever Tetanus Toxic Shock Syndrome Trichinosis Tuberculosis Tularemia Typhoid Typhus Yellow Fever Yersiniosis �2.
