Summary

This bill would require the Department of Health and Mental Hygiene (DOHMH) to implement a campaign to inform the public about assisted outpatient treatment ordered by a court pursuant to section 9.60 of the New York State mental hygiene law, also known as Kendra’s Law, which allows certain people, including family members, to petition a court to mandate outpatient treatment for a person suffering from mental illness if certain criteria are satisfied. DOHMH would also be required to provide assistance to individuals who wish to file a Kendra’s Law petition in court, including guidance on how to complete the petition.

Be it enacted by the Council as follows: Section 1. Chapter 1 of title 17 of the administrative code of the city of New York is amended by adding a new section 17-199.12 to read as follows: � 17-199.12 Assisted outpatient treatment; public outreach. a. The department of health and mental hygiene shall implement a public information and outreach campaign designed to inform the public about assisted outpatient treatment ordered by a court pursuant to section 9.60 of the mental hygiene law. Such campaign shall include information about the assistance provided by the department pursuant to subdivision b. b. The department shall provide assistance to individuals who wish to initiate a petition to the court for assisted outpatient treatment pursuant to section 9.60 of the mental hygiene law. Such assistance shall include guidance on how to complete and file such petition. � 2. This local law takes effect 90 days after it becomes law. NAB LS #10657 12/12/19 10:50am 1
