Be it enacted by the Council as follows: Section 1. Chapter one of title seventeen of the administrative code of the city of New York is hereby amended by adding a new section 17-178 to read as follows: �17-178. Gunshot and certain other wounds to be reported. a. Every case of a bullet wound, gunshot wound, powder burn or any other injury arising from or caused by the discharge of a gun or other firearm to a person less than nineteen years old shall be reported in writing to the department by (i) the physician attending or treating the case or (ii) the manager, superintendent or other person in charge, whenever such case is treated in a hospital, sanitarium, institution or other medical facility. Such report shall be provided to the department as soon as practicable and shall be made on forms furnished by the department or shall contain all the information required by such forms. This section shall not apply to wounds, burns or other injuries received by a member of the armed forces of the United States or the state of New York while engaged in the actual performance of duty. b. Not later than twelve months after the effective date of this local law, and each year thereafter, the department shall submit a report to the mayor and the city council which provides relevant epidemiological data compiled from submitted reports, including but not limited to the following: (1) the age of the person injured, classified in the age categories of 0-4 years, 5-9 years, 10-14 years and 15-19 years inclusive; (2) the sex of the person injured; (3) the race of the person injured; (4) the educational level of the person injured; (5) any history or indications of prior wounds, burns or other injuries arising from or caused by the discharge of a gun or firearm to the person injured; (6) the general geographic location of where the wound, burn or other injury occurred, specifying zip code and whether such location was also the residence, workplace or school of the person injured; (7) the circumstances concerning the infliction of the wound, burn or other injury, including information as to whether such an injury was inflicted intentionally or accidentally, involved one or more persons being injured and was related to any criminal activity; (8) the type of gun or firearm causing the injury; and (9) the body part or parts injured and the trauma score or injury severity score, including information on survival and any long term disability. c. Any person who fails to report a wound as required by subdivision a of this section shall be guilty of a misdemeanor and shall be liable for a civil penalty pursuant to subdivision a of section 17-133 of this chapter. �2. This local law shall take effect ninety days after its enactment. 1 2
